2. Service Features and Availability
2.1. Platform Features: Masi Chat provides chatbot creation, live chat and marketing tools especially for customer support and engagement.
2.2. Service Updates: We reserve the right to update or modify the Service to improve functionality or meet legal requirements. Some updates may result in temporary downtime.
3. Payments, Billing, and Refunds
3.1. Pricing and Currency:
- All subscription fees are charged in USD.
3.2. Payment Methods:
- Payments are processed through secure third-party gateways, including 2Checkout.
3.3. Billing Cycle: Subscriptions are billed in advance based on your selected plan (monthly or yearly).
3.4. Refund Policy: Refunds are issued only if:
- A verified platform issue prevents use of the Service.
- The issue cannot be resolved within 72 hours of you providing required access or information.
- The issue is specific to Masi Chat and not caused by third-party hosting or your device setup.
3.5. Taxes and Fees:
- Subscription fees are exclusive of applicable taxes, levies, or duties. You are responsible for any additional charges imposed by your jurisdiction.
4. Account Suspension and Termination
4.1. Suspension: Accounts violating these Terms or exceeding allocated usage quotas may be suspended temporarily or permanently.
4.2. Termination: We may terminate your account for violations of these Terms, resulting in loss of access to your account and associated data.
5. Intellectual Property and Use Restrictions
5.1. Ownership:
- Masi Chat, including its software, website, and related materials, is the intellectual property of Mlita Solutions (Pty) Ltd.
- No ownership rights are transferred to you through use of the Service.
5.2. Use Restrictions:
- You may not copy, distribute, resell, or modify any part of the platform without prior written consent.
- You may not use Masi Chat for any purpose that infringes the intellectual property rights of others.
6. Referral Program
6.1. Eligibility: Users can participate in the referral program and earn up to 20% commissions for new customers they refer.
6.2. Payment Terms: Referral earnings are processed after verification and subject to program-specific terms available in your account dashboard.
7. Limitation of Liability
7.1. No Guarantees:
- Masi Chat is provided “as is,” without warranties of any kind.
- We do not guarantee uninterrupted access or error-free functionality.
7.2. Liability Cap:
- To the fullest extent permitted by law, Mlita Solutions’ liability is limited to the fees paid by you in the past 12 months.
8. Global Access and Legal Compliance
8.1. Global Accessibility: Masi Chat is accessible worldwide, but certain features or integrations may be region-specific.
8.2. User Responsibility: You must comply with all local laws governing your use of the Service, including data privacy and consumer protection regulations.
9. Modifications to the Terms
We may revise these Terms periodically. Changes will take effect immediately upon being posted on our website. You are encouraged to review the Terms regularly to ensure compliance.
